The article which was published for the first and single time in 1939, is the starting point of Leo Strauss’ “esoteric” scholarship. While devoted to the investigation of Xenophon’s treatise called Constitution of the Lacedemonians the article, using it as an example, shows reasons, techniques, and the meaning of writing “between the lines”. Strauss sequentially shows how Xenophon hides his critique of the Spartan constitution behind the facade of an encomium. But what may be even more important, in the piece (...) Strauss clearly tries to overcome the established 19th-century view that Xenophon was a mediocre and charged with laconophilia historian; he tries to reinstate Xenophon’s position as that of a serious thinker: a Socratic philosopher. He shows how meticulously Xenophon studies the Spartan constitution and that this apparently very successful and very stable regime, in fact, deserves serious politico-philosophic critique. Thereby he partially reveals the essence of classical political philosophy to careful readers. (shrink)

In this paper, I explore what gives collective testimony its epistemic credentials, through a critical discussion of three competing accounts of the epistemology of collective testimony. According to the first view, collective testimony inherits its epistemic credentials from the beliefs the testimony expresses— where this can be seen either as the beliefs of all or some of the group’s members, or as the beliefs of group itself. The second view denies any necessary connection to belief, claiming instead that the epistemic (...) credentials of collective testimony derive from the reliability or truth-conduciveness of the statement that expresses the testimony. Finally, the third view claims that the epistemic credentials of collective testimony derive from the fact that it involves undertaking a collective commitment to trustworthiness, which makes the group susceptible to rebuke and blame if its testimony is not trustworthy. I argue that this last account holds the most promise for preserving what is distinctive about testimonial knowledge while still underwriting a robust epistemology of collective testimony. (shrink)

Over the past few decades, Indigenous communities have successfully campaigned for greater inclusion in decision-making processes that directly affect their lands and livelihoods. As a result, two important participatory rights for Indigenous peoples have now been widely recognized: the right to consultation and the right to free, prior and informed consent (FPIC). Although these participatory rights are meant to empower the speech of these communities—to give them a proper say in the decisions that most affect them—we argue that the way (...) these rights have been implemented and interpreted sometimes has the opposite effect, of denying them a say or ‘silencing’ them. In support of this conclusion we draw on feminist speech act theory to identify practices of locutionary, illocutionary, and perlocutionary group silencing that arise in the context of consultation with Indigenous communities. Recent feminist philosophy of language has highlighted the ways that the speech of women can be unjustly impeded, because of the way their gender affects the uptake their speech receives. In this chapter, I explore how similar processes can undermine the speech of a different sort of speaker: Indigenous communities. This involves focusing on Indigeneity rather than gender as the salient social identity, and looking at the ways that group speech, rather than only individual speech, can be unjustly impeded. To (...) do this, I make use of the notion of ‘discursive injustice’ that has been developed by Quill Kukla, and, with reference to three case studies, show how discursive injustice can effectively derail the speech of Indigenous communities. The Securities and Exchange Commission (SEC) sanctioned investor-paid rating agency Egan-Jones for falsely stating that it did not know its clients’ investment positions. The SEC’s action against Egan-Jones raises the broad question whether knowledge of clients’ investment positions creates a conflict of interest for investor-paid ratings. In an experimental setting, we find that investor-paid rating agencies are likely to assign credit ratings that are biased in favor of their clients’ positions, and that this effect is attenuated when the rated company (...) has a sophisticated investor base that is expected to scrutinize ratings. The effect is not conditional on the risk profile of the rated companies. Taken together, our findings suggest that a conflict of interest stemming from investors’ preferences is likely to bias ratings under investor-pays business models, but scrutiny by the company’s investor base can counteract this bias. In the paper ‘COVID-19 vaccine boosters for young adults: a risk–benefit assessment and ethical analysis of mandate policies at universities,’ Bardoshet alargued that college mandates of the COVID-19 booster vaccine are unethical. The authors came to this conclusion by performing three different sets of comparisons of benefits versus risks using referenced data and argued that the harm outweighs the risk in all three cases. In this response article, we argue that the authors frame their arguments by comparing values that are (...) not scientifically or reasonably comparable and that the authors used values that represent grossly different risk profiles and grouped them into a set of figures to create an illusion of fair comparisons. We argue that absent the falsely skewed portrayals of a higher level of risk over benefit in their misrepresented figures, the five ethical arguments they presented completely fall apart. (shrink)

Trans of Color inclusion is not simply a gesture of affectionate commitment to María Lugones's theory of impure communities. Rather, it is required for the enactment of her liberatory theory within and across communities of color. While María Lugones's historico-theoretical analysis of the colonial/modern gender system relies upon anthropological citations of Native gender and sexual diversity, she argues that we must bracket gender for the benefit of [cis]women of color feminisms. However, if this bracketing does not first carefully uncover cisgender (...) histories of violence, then this decolonial feminist praxis reinscribes the invisibility of transphobia, racism, and colonialism's violent intersections, performing another mode of erasure and silence on Trans, Two-Spirit, and Nonbinary Native, Black, and Latinx peoples. In placing Lugones's texts into conversation with the voices of Two-Spirit and Trans of Color theorists, I argue that the mutilation of trans flesh makes possible the integration of [cis]People of Color into the gender–sex binary even if as failures. More important, this essay offers the beginnings of a phenomenological account of Trans World-Traveling, where the unruliness of Two-Spirit and Trans of Color bodies cocoons decolonial worlds from within the spiraling folds of abject flesh—always already in infra-communication with ancestral pasts, presents, and futures. In summary, then, this discussion indicates one of the ways in which Simpson participated in the “modern evolutionary synthesis” by focusing on his developing concept of the species. In particular, we see him moving from species-as-types to species-as-populations, and next to how those populations, through organism-environment interactions, might give rise to new species, some of which rapidly lead to higher taxa.Simpson's participation in the creation of the modern synthesis is more generally evident here by his contribution to what V. B. (...) Smocovitis has recently termed the “quantification of evolution — the attachment of numbers to ‘nature.’” Smocovitis rightly views such quantification as an essential ingredient for the formulation of the evolutionary synthesis; however, she neglects Simpson's role in this regard. As suggested here and demonstrated more fully elsewhere, Simpson's commitment to a positivistic philosophy often found expression in quantitative argumentation, even if the paleontological data upon which such arguments were based were limited in number and precision. This is a review of Larry Alexander and Kim Ferzan’s _Reflections on Crime and Culpability_, a sequel to the authors’ _Crime and Culpability_. The two books set out a sweeping proposal for reforming our criminal law in ways that are at once commonsensical and mindbogglingly radical. But even if one is not on board with such a radical experiment, simply thinking it through holds many unexpected lessons: startlingly new insights about the current regime and about novel ways of doing legal (...) theory, some of which are explored in this essay. The eukaryotic genome is a mosaic of eubacterial and archaeal genes in addition to those unique to itself. The mosaic may have arisen as the result of two prokaryotes merging their genomes, or from genes acquired from an endosymbiont of eubacterial origin. A third possibility is that the eukaryotic genome arose from successive events of lateral gene transfer over long periods of time. This theory does not exclude the endosymbiont, but questions whether it is necessary to explain the peculiar set (...) of eukaryotic genes. We use phylogenetic studies and reconstructions of ancestral first appearances of genes on the prokaryotic phylogeny to assess evidence for the lateral gene transfer scenario. We find that phylogenies advanced to support fusion can also arise from a succession of lateral gene transfer events. Our reconstructions of ancestral first appearances of genes reveal that the various genes that make up the eukaryotic mosaic arose at different times and in diverse lineages on the prokaryotic tree, and were not available in a single lineage. Successive events of lateral gene transfer can explain the unusual mosaic structure of the eukaryotic genome, with its content linked to the immediate adaptive value of the genes its acquired. Progress in understanding eukaryotes may come from identifying ancestral features such as the eukaryotic splicesome that could explain why this lineage invaded, or created, the eukaryotic niche. The paper illustrates how organic chemists dramatically altered their practices in the middle part of the twentieth century through the adoption of analytical instrumentation — such as ultraviolet and infrared absorption spectroscopy and nuclear magnetic resonance spectroscopy — through which the difficult process of structure determination for small molecules became routine. Changes in practice were manifested in two ways: in the use of these instruments in the development of ‘rule-based’ theories; and in an increased focus on synthesis, at the expense (...) of chemical analysis. These rule-based theories took the form of generalizations relating structure to chemical and physical properties, as measured by instrumentation. This ‘Instrumental Revolution’ in organic chemistry was two-fold: encompassing an embrace of new tools that provided unprecedented access to structures, and a new way of thinking about molecules and their reactivity in terms of shape and structure. These practices suggest the possibility of a change in the ontological status of chemical structures, brought about by the regular use of instruments. The career of Robert Burns Woodward provides the central historical examples for the paper. Woodward was an organic chemist at Harvard from 1937 until the time of his death. In 1965, he won the Nobel Prize in Chemistry. (shrink)

How we talk about relations has a great influence on how we think about relations. By saying that Spain defeated the Netherlands we obviously say something entirely different from saying that the Netherlands defeated Spain. This makes many of us think that in the underlying relation itself one of the relata comes first and the other comes second. However, there are good reasons to view the order as a representational artifact. In this paper I present a new logic that allows (...) us to think and talk about relations in a coordinate-free manner. The logic is minimalistic in the sense that it has no predicates except equality, but its expressive power is the same as that of first-order predicate logic. (shrink)

In this paper I critically discuss Miranda Fricker’s ‘trust-based’ view of collective testimony—that is, testimony that comes from a group speaker. At the heart of Fricker’s account is the idea that testimony involves an ‘interpersonal deal of trust’, to which the speaker contributes a commitment to ‘second-personal epistemic trustworthiness’. Appropriating Margaret Gilbert’s concept of joint commitment, Fricker suggests that groups too can make such commitments, and hence that they, like individuals, can ‘enter into the second-personal relations of trust that characterise (...) testimony’ (Fricker 2012: 272). I argue that this choice to appropriate Gilbert’s concept of joint commitment betrays a deep problem in Fricker’s account—a misconstrual of both the object and the subject(s) of the commitment a speaker makes in testifying. After developing this criticism, I outline an alternative way of construing the speaker’s commitment, which can be applied to both collective and individual testimony. (shrink)

A new logic is presented without predicates—except equality. Yet its expressive power is the same as that of predicate logic, and relations can faithfully be represented in it. In this logic we also develop an alternative for set theory. There is a need for such a new approach, since we do not live in a world of sets and predicates, but rather in a world of things with relations between them.

Each annual Ontology Summit initiative makes a statement appropriate to each Summit’s theme as part of our general advocacy designed to bring ontology science and engineering into the mainstream. The theme this year is "Towards an Open Ontology Repository". This communiqué represents the joint position of those who were engaged in the year's summit discourse on an Open Ontology Repository (OOR) and of those who endorse below. In this discussion, we have agreed that an "ontology repository is a facility where (...) ontologies and related information artifacts can be stored, retrieved and managed." -/- We believe in the promise of semantic technologies based on logic, databases and the Semantic Web, a Web of exposed data and of interpretations of that data (i.e., of semantics), using common standards. Such technologies enable distinguishable, computable, reusable, and sharable meaning of Web and other artifacts, including data, documents, and services. We also believe that making that vision a reality requires additional supporting resources and these resources should be open, extensible, and provide common services over the ontologies. (shrink)

The essays in this collection explore the idea that discursive norms--the norms governing our thought and talk--are profoundly social. Not only do these norms govern and structure of social interactions, but they are sustained by a variety of social and institutional structures. The chapters are divided into three thematic sections. The first offers historical perspectives on discursive norms, including a chapter by Robert Brandom on the way Hegel transformed Kant's normativist approach to representation by adding both a social and a (...) historicist dimension to it. Section II features four chapters that examine the sociality of normativity from within a broadly naturalistic framework. The third and final section focuses on linguistic phenomena such as online speech acts, oppressive speech, and assertions. The Social Institution of Discursive Norms will be of interest to scholars and advanced students working in philosophy of language, philosophy of mind, and social philosophy. (shrink)
